This page sets out general terms. The selected service, customer details, total price, service period and other order details must be provided separately before an order is accepted. Visiting this website or sending an enquiry does not create a paid order.
2. Services covered
Depending on the accepted order, services may include email marketing, transactional email, SMTP relay, SMS, WhatsApp, Web Push, OTP, email validation, marketing automation, reporting, consent management integrations, API integration, software development, design and consultancy. Services are delivered electronically; physical shipment is not part of these services.
The selected channels, contact or sending limits, credits, access period, technical requirements and support scope are specified in the order or quotation. A service listed on the website is not automatically included in every package.
3. Order, price and payment
Before the customer accepts an order, the service scope, price including applicable taxes, currency, payment method, start date, duration and any additional charges must be made clear. For foreign currency pricing, the applicable conversion terms must also be stated before acceptance. Extra services and additional charges require the customer's approval.
WhatsApp platform charges and Meta messaging charges may be separate items. Operator, channel provider and other usage charges apply only as disclosed in the accepted order. Monthly or annual billing, quotas and any renewal terms are determined by that order; this page alone does not authorise automatic renewal or recurring payment.
4. Activation and performance
Access or service delivery starts on the agreed date after the payment and setup requirements specified in the order are met. Domain verification, DNS settings, API credentials, approved templates or channel account approvals may be needed. The parties cooperate on the necessary setup and provide accurate information.
Deliverability and timing may be affected by recipient preferences, mailbox providers, operators and channel rules. No universal inbox placement, reading, sales or campaign result is guaranteed. This does not remove the Provider's responsibility for the service it has undertaken to deliver or the customer's statutory rights.
5. Customer responsibilities
The customer is responsible for obtaining a lawful basis for processing recipient data, providing notices, collecting commercial messaging permissions where required, respecting opt-outs and using lawful content. Purchased or unauthorised contact lists, spam and uses that infringe third-party rights are not permitted. Account and API credentials must be protected; suspected misuse should be reported promptly.
Necessary restrictions may be applied to unlawful or security-threatening use, with information to the customer where possible. Such restrictions do not automatically remove any refund or other statutory entitlement.
6. Withdrawal, cancellation and refunds
For customers acting outside their trade or profession and qualifying as consumers under Turkish law, the statutory withdrawal period for a service contract is 14 days from its conclusion, subject to the legal exceptions. The conditions, notification methods and refund procedure are explained in the Cancellation and Refund Agreement.
Instantly performed electronic services, instantly delivered intangible goods and services started with the consumer's approval before the withdrawal period expires may fall within statutory exceptions when their legal conditions are met. A service being described as digital does not by itself exclude all refund rights.
If performance becomes impossible, the consumer is notified in writing or through a durable medium within three days of the Provider learning of this, and payments collected are refunded within 14 days of that notice. Rights relating to defective or incomplete performance remain reserved.
7. Confidentiality and personal data
The Privacy Agreement and Personal Data Notice explain website data practices. Customer data processed to perform a service is also subject to the applicable service and data processing terms. Reading or accepting these terms does not constitute blanket consent to marketing or personal data processing.
8. Applicable rules and complaints
Turkish law applies. Mandatory consumer protections prevail over any conflicting term. Consumers may apply to consumer arbitration committees or consumer courts according to the applicable jurisdiction and monetary limits; mandatory mediation rules apply where required. For business purchases, the accepted quotation, service contract and applicable general law govern.
Requests and complaints may be sent to destek@message34.com or the Provider's address above. Updates to this page do not retrospectively reduce rights arising from an existing order.
